A landmark work by the celebrated French jurist Robert-Joseph Pothier, one of the most influential civil law scholars in European legal history. His writings became a major doctrinal foundation for the Napoleonic Code and later civil codes throughout Europe and Latin America, including the Argentine Civil Code.

Published in Barcelona in 1846, this Spanish edition was translated and supplemented with notes adapting the text to Spanish law under the direction of Mariano Noguera and Francisco Carles.

The treatise provides a comprehensive analysis of marriage as a civil contract, discussing its legal foundations, the requirements for its validity, matrimonial consent, the rights and duties of spouses, matrimonial property regimes, marital authority, and the legal consequences arising from marriage. Combining Roman law, French legal tradition and classical doctrine, the work became one of the most respected references in nineteenth-century civil law scholarship.

 

Today it remains an important historical source for legal historians, academic libraries, researchers and collectors of rare legal books.
